REPORT ON HB-449 and SB-412, two bills which would stop governments from filing frivolous and reckless lawsuits against gun manufacturers

HB-449 was on the Special Order Calendar for the House Floor April 10 and never had a chance to be heard.

Liberal Democrats in the House argued, questioned, tried to amend many bills and appeared to intentionally slow down the proceedings of the House. Out of 42 bills scheduled to be heard yesterday afternoon, only 16 were actually heard.

Anti-gun Democrats have also filed 5 gun-control amendments to try to put on HB-449 on the floor when the bill does comes up. The House will not meet again in Session until Monday afternoon April 16, 2001.

BILL SUMMARY: HB-449 CIVIL ACTIONS/GUN MANUFACTURERS
Prohibits any lawsuit by, or on behalf of, the state, county, municipality, town, special purpose district or other political subdivision for damages, abatement, or injunctive relief resulting from the lawful design, marketing, distribution, or sale of firearms or ammunition to the public. Provides that the potential of a firearm or ammunition to cause injury, damage, or death is not a defective condition, whether the firearm or ammunition is discharged legally or illegally. Provides for the award of expenses and attorney`s fees.


REPORT ON SENATE FLOOR ACTION ON SB-412 April 12

SB-412 By Bronson PASSED SENATE 27-12

SB-412 was on Third Reading and Final Passage on the Senate Floor today. Anti-gun Senate Democrats stood in line to speak against the bill to no avail. The bill PASSED by a vote of 27-12.

The bill was Immediately Certified to the House and will be there when the House comes back in Session next week.
