California:  "Assault Weapon" Regulations Take 3: CA DOJ Resubmits Regulations

Today, July 21, the California Department of Justice (“DOJ”), without warning or any notification,  submitted another set of proposed regulations for the registration of newly classified “assault weapons” to the Office of Administrative Law.  As with their past two attempts, DOJ has once again listed these regulations as “File and Print Only,” meaning that members of the public will not have an opportunity to comment on any of the proposed regulations. 

As reported previously, DOJ’s prior attempt at burdensome and unnecessary regulations was denied by the Office of Administrative Law after the NRA and CRPA attorneys submitted a comprehensive opposition letter, which point-by-point dismantled DOJ’s arguments in support of its regulations. 

While we do not yet have a copy of the proposed text for this new set of regulations, the sections listed for proposed “adoption” mirror those of DOJ’s prior proposal, which suggests DOJ is once again attempting to overstep its regulatory authority. 

The NRA and CRPA attorneys are currently working to obtain a copy of the proposed text, and will be providing members with more information as it becomes available.
