Maine: Firearm Surrender Bill to be Filed

On February 27th, the Legislative Council met to approve requests to introduce emergency legislation for the remaining 2018 legislative session.  Several of the requests before council included anti-gun proposals to ban certain firearm accessories as well as ban standard capacity magazines.  Fortunately, these proposals failed to get the support necessary for introduction.

However, the council did approve LR2943, presented by Senator Mark Dion (District 28-D), which would create a new community extreme risk protection order.  Extreme Risk Protection bills allow for the issuance of protective orders to infringe on Second Amendment rights based on third party allegations and little, if any, real evidence and limited “due process” for the respondent.

Constitutional rights should only be restricted with proper due process of law.  The reasons for this are two-fold.  It limits restrictions on constitutional rights to only serious convictions and adjudications that provide greater procedural protections to  the accused, which results in more reliable proceedings.  The Right to Keep and Bear Arms should not be treated as a second-class right and should only be restricted consistent with the constitutional requirements of due process.

Please stay tuned to www.nraila.org and your email inbox for further updates as this measure moves through the legislative process.
