Yesterday, the U.S. Court of Appeals for the Third Circuit allowed an unconstitutional magazine ban to proceed with its December 10th deadline by a 2-1 decision. The lone dissenting opinion, Judge Bibas, pointed out that the majority refused to acknowledge the Second Amendment as equal to others stating, “The Second Amendment is an equal part of the Bill of Rights. We must treat the right to keep and bear arms like other enumerated rights, as the Supreme Court insisted in [District of Columbia v. Heller, 554 U.S. 570 (2008)].”
With strong support from NRA, the ANJRPC fully intends to appeal this decision. For more information, please see our previous alert. Your NRA will continue to keep you updated with more information when it becomes available.
