Nevada: Senate Passes AB 291, On to Assembly for Concurrence

On May 31^st, the Nevada Senate voted to pass AB 291 with “red flag” language as amended by the Senate Judiciary Committee, to allow for the seizure of firearms without due process.  AB 291 will now head back to the Assembly for concurrence.  During this session, the Assembly never held hearings to consider this firearm seizure language and will likely not before simply bringing AB 291 to the floor for a concurrence vote.  Please contact your Assembly Member and urge them to OPPOSE concurrence for AB 291.  Click the “Take Action” button below to contact your Assembly Member.  In addition, please call Governor Steve Sisolak at (775) 684-5670 and urge him to oppose this bill.

Assembly Bill 291, introduced by Assemblywoman Sandra Jauregui (D-41), is omnibus anti-gun legislation that, as passed by the Senate, will: 

• Create Red Flag/Pre-Crime Protective Orders that allow for the removal of a person's constitutional rights not because a person has been convicted of a crime or adjudicated mentally ill, but instead on third party allegations.  This legislation lacks strong due process protections and contains low evidentiary standards that fall well below the norm for removing fundamental constitutional rights. 
• Impose Mandatory Storage Requirements that would expand Nevada's current law regulating firearm storage by imposing a one-size-fits-all government standard that requires firearms to be made unavailable for self-defense.
• Criminalize Certain Firearm Modifications: With the amendments, this legislation remains broader than existing federal regulations, and would criminalize certain modifications on semi-automatic firearms.  Violations of this section would result in felony penalties.
