House Bill 9 by Rep. Pamela Herndon (D-ABQ), a bill that creates back-door storage requirements by imposing criminal penalties on gun owners if a third-party minor accesses and brandishes or injures someone with their firearm, is being fast-tracked and will be voted on by the Senate today. Please contact your State Senators before NOON MST today and urge them to OPPOSE HB 9.
Firearms safety is something that is achieved through education, not punitive law that only comes into play after an accidental or intentional discharge occurs. HB 9 has no education or community outreach component and, instead, attempts to dictate how firearms must be stored in the home, vehicle or place of business -- giving criminals an advantage by limiting law-abiding citizens' access to firearms for protection.
HB 9 lacks adequate exemptions for authorized access to firearms by minors for common activities such as hunting or 4-H competitions. And under New Mexico's current child abuse/abandonment statute, prosecutors have the tools to hold parents, guardians or other custodians of children accountable when a child is placed in a situation that may endanger his or her life or health, such as exposure and access to deadly weapons, poisons, or drugs.
