On Thursday, May 8th, Governor Greg Gianforte signed House Bill 809 into law, protecting citizens against localized "red flag" laws and any outside funding intended to promote the use of such schemes.
The NRA thanks Governor Gianforte, lead sponsor Representative Mitchell, all legislators who supported this bill, and all NRA members and fellow Second Amendment advocates who engaged with their legislators this session.
HB 809 prevents local governments from enacting or enforcing an extreme risk protection order (ERPO) or accepting any grants that would aid in the adoption or enforcement of an ERPO. Red flag laws allow governments to seize firearms based on weak and nebulous standards of evidence and implement ex-parte hearings that would suspend an individual's Second Amendment rights without due process.
