On Monday, the Delaware General Assembly adjourned sine die, closing out the 2025 legislative session with action on key public safety bills. Lawmakers passed Senate Bill 82, a measure that significantly expands the state’s “Red Flag” law. The Bill has been transmitted to Governor Carney’s desk and is awaiting action. As amended, SB 82 drastically extends the duration of lethal violence protective orders from one to five years, and grants sweeping authority for courts to order the seizure of firearms, projectile weapons, and ammunition. Further, SB 82 threatens due process and Second Amendment protections by allowing prolonged disarmament based on vague and subjective standards.
House Bill 45, which would have required financial institutions to track firearm and ammunition purchases using a special Merchant Category Code (MCC), failed to pass.
