Idaho: Legislature Adjourns Sine Die from 2026 Session

On Thursday, April 2nd, the Idaho Legislature adjourned sine die from the 2026 legislative session. SB 1430 received final passage and will soon be transmitted to Governor Brad Little's desk for his consideration. 

Senate Bill 1430 creates a civil penalty and permanent injunction for any county, city, or locality that violates statewide firearms preemption laws. The legislature’s intent to wholly regulate firearms laws should be matched with the legislature’s intent to enforce those laws.  This bill ensures residents of Idaho never have to worry about a patchwork of different gun laws when traveling in the state, and bad actors can be held accountable for violating Idaho’s state statutes regarding firearms, ammunition, or components.

After facing delays all session, pro-Second Amendment House members took a final stand in support of House Bill 621, passing it out of the House just hours before sine die. Though not given the time to pass out of the Senate, the House action shows a commitment to address this issue next session. H 621 provides clarifying language to existing state statutes that the lawful carry of firearms is only prohibited in the courthouse portions of government buildings. Local governments have been broadly interpreting language that prohibits firearms in courthouses, to extend this prohibition to an entire building or complex, despite a courthouse only taking up a small portion. This legislation will remedy that ambiguity.
