Minnesota: Constitutional/Permitless Carry Legislation Introduced

This week, House File 188, permitless/constitutional carry legislation, and House File 238, stand your ground legislation, were both introduced in the Minnesota Legislature.  Your NRA-ILA will work to see that these bills are given full consideration by the Minnesota House and Senate.  A special thanks is given to state Representative Nash for introducing these pieces of legislation so early in the legislative session.

HF 188 would eliminate the requirement to obtain a permit in order to lawfully carry.  This bill recognizes a law-abiding adult’s unconditional Right to Keep and Bear Arms for self-defense in the manner he or she chooses.  Self-defense situations are difficult, if not impossible, to anticipate.  Accordingly, a law-abiding adult’s right to defend himself or herself in such situations should not be conditioned by government-mandated time delays and taxes. 

HF 188 does not eliminate Minnesota’s current carry permitting system.  An optional carry permit will still be available for Minnesotans who choose to obtain one.

HF 238 would make numerous reforms to Minnesota’s self-defense laws.  Among the reforms in HF 238 would be the elimination of the common law duty to retreat in cases of self-defense.
