Man who fired shot that killed Penbrook robbery suspect won't be charged

The man who fired a shot that killed a 16-year-old teen during a Penbrook robbery Thursday won't be charged, said the Dauphin County district attorney's office. "It was a self-defense situation where he was entitled to defend himself," said Michael Sprow, chief Dauphin County deputy district attorney. He declined to name the 16-year-old male victim because he is a juvenile. The man who fired the shot was Harvey Eden, who lived in the home in the 2500 block of Walnut Street, Penbrook, Sprow said. He fired after seeing a masked man holding a hammer in his dining room, Sprow said. "He's in fear for his safety so he shoots," Sprow said. Once someone break s into a home unlawfully, "the laws allow you to defend your house with deadly force," he said. The teen was shot once in the chest in the dining room of the house, and died on scene despite CPR efforts by responders. Another teen who had been with the 16-year-old fled and was later arrested. Davaughn Jackson, 19, of South 28th Street, Penbrook, is charged with robbery, burglary, conspiracy and related counts. He and the 16-year-old broke in through a back window of the home, Sprow said. Jackson told police they broke in "to steal an Xbox and video games and money," Sprow said. Jackson was identified through witness descriptions, he said. Investigators are still trying to determine if they had a connection to anyone in the home. When the shooting occurred, the son of the resident's girlfriend was upstairs, Sprow said. The gun used was a semi-automatic handgun, Sprow said.
