California: Two Budget Bills with Anti-Gun Language Moving to the Floor of the State Assembly and Senate

Tomorrow, June 15, is the deadline for the California Legislature to pass a budget. Two budget trailer bills, AB 103 and SB 87, were recently amended with identical anti-gun language and will be voted on tomorrow. Both AB 103 and SB 87 were recently amended to include substantial policy changes that would remove your Second Amendment rights without due process.  

In the state Senate Assembly Bill 103, passed the Senate Budget and Fiscal Review Committee yesterday, June 13, and will eligible for a vote on the Senate Floor tomorrow, June 15.  

In the state Assembly, Senate Bill 87, was withdrawn from the Assembly Budget Committee and will be sent straight to the Assembly floor for a vote tomorrow, June 15. 

Current law prohibits a person from owning, purchasing, receiving, possessing, or having under his/her custody or control a firearm upon conviction of a felony or for ten years upon conviction of a specified misdemeanor (29085 pc). 

AB 103 and SB 87 would make a substantial change to current law by significantly expanding the prohibiting categories for firearms and ammunition to include persons who have a warrant for a felony or disqualifying misdemeanor. This drastic policy change will violate an individual’s right to due process as warrants can be issued without notice or hearing. Furthermore, this policy is not germane to the budget and would circumvent the normal legislative process for policy measures. 

Both bills also allow for additional money and a time for the Department of Justice to implement and allow for the registration of newly classified “assault weapons.” To read more on the recently submitted “assault weapon” regulations click here.
