California: Budget Trailer Bill with Anti-Gun Language, AB 103, Heading to Governor Brown

Today, June 15, was the deadline for the California Legislature to meet the budget deadline. Anti-gun Legislators ramrodded Assembly Bill 103 through the process, where it passed the Senate and then was promptly brought to the Assembly floor without reference to file and subsequently passed. AB 103 will now be sent to Governor Brown for his consideration.  Please use our TAKE ACTION button below to email Governor Brown and urge him to VETO AB 103.  Also take a moment to CALL Governor Brown’s office at (916) 445-2841 to ensure he hears your OPPOSITION to AB 103.

Senate Bill 87, the second budget trailer bill with identical anti-gun language, had not been brought to the Assembly by the posting of this alert.  However this legislation has identical language to AB 103 and is unnecessary to act on.  

AB 103 would change current law by significantly expanding the prohibiting categories for firearms and ammunition to include persons who have a warrant for a felony or disqualifying misdemeanor.  Current law prohibits a person from owning, purchasing, receiving, possessing, or having under his/her custody or control a firearm upon conviction of a felony or for ten years upon conviction of a specified misdemeanor (29085 pc).  AB 103’s drastic policy change will violate an individual’s right to due process as warrants can be issued without notice or hearing.  Furthermore, this policy is not germane to the budget and would circumvent the normal legislative process for policy measures. 

AB 103 also would allow for additional money and a time for the Department of Justice to implement and allow for the registration of newly classified “assault weapons.” To read more on the recently submitted “assault weapon” regulations click here. 

The fight in the Legislature is far from over.  On Tuesday, June 20, Assembly Bill 7 has been rescheduled to be heard in the Senate Public Safety Committee.  As previously reportedAssembly Bill 7, sponsored by Mike Gipson (D-64), would further extend California’s ban on the open carry of an unloaded firearm while in or upon a public place or street within a prohibited area located within the unincorporated area of a county.  Please use our TAKE ACTION button above to also contact the members of the Senate Public Safety Committee and CALL the following Committee Members and urge them to OPPOSE AB 7.
