Alabama: House Hearing Voluntary Gun Ban Blacklist

After the Legislature passed constitutional carry, the greatest pro-gun legislation in Alabama history, proven anti-gun Representatives Neil Rafferty and Allen Farley have refused to back down and, once again, seek to prove their loyalty to the gun ban lobby extremists. Next week, the House will consider House Bill 462, to create a state registry of individuals who renounce their Second Amendment rights. Please contact your state representative and ask them to OPPOSE HB 462.

House Bill 462 creates the Voluntary Alabama Firearms Do-Not-Sell List where individuals can apply with the state to add themselves, with the information sent to FBI’s NICS. In addition to licensed firearm dealers being prohibited from transferring firearms to them, punishable as a Class A misdemeanor, those individuals will be prohibited from possessing or transporting firearms, punishable as a Class C misdemeanor. While the bill provides for a number of simple methods for individuals to register themselves for the list, removal from the list is more complicated. Such individuals, who would have never been convicted of a disqualifying crime or been found to be mentally defective, have to apply to a district court and prove that they are not a danger in order to get their rights restored. This scheme creates opportunities for abuse by both local and federal bureaucracies, as well as opportunities for anti-gun family members and friends to pressure individuals to renounce a constitutional right that will be difficult to recover.
