Next Wednesday, the supposedly pro-gun supermajority in the Alabama House will hold a hearing on House Bill 12, a bump stock ban, and House Bill 58, which creates a criminal penalty for not informing law enforcement a lawful citizen is carrying or possessing a firearm. The House Judiciary Committee hearing is scheduled for Wednesday, February 12, 2025, at 1:30 PM. Please use the TAKE ACTION button below to directly contact committee members and urge them to oppose House Bills 12 and 58.
House Bill 12 bans an individual from possessing, obtaining, receiving, selling, or using a bump stock by making it a Class C Felony. Last year, the Supreme Court ruled that the federal ban on bump stocks was unconstitutional in a 6–3 decision in the Garland v. Cargill case. The Supreme Court held that the NFA’s definition of “machinegun” clearly does not cover bump stocks and thus that the ATF exceeded its statutory authority by classifying bump stocks as such.
House Bill 58 creates a new crime for a person's failure to inform law enforcement, upon request, that they are carrying or possessing firearms. This will have a disproportionate impact on law-abiding persons carrying firearms, as those in violation cannot be compelled under the fifth amendment to incriminate themselves.
