New Mexico: House Committee To Hear Four Anti-Gun Bills on Monday*

*In an effort to give you as much advance notice as possible, we are sending this alert out before an official committee agenda is posted.  Please check here  over the weekend for the official House Judiciary Committee agenda for Monday.*

On Monday, January 29, the House Judiciary Committee will hold public hearings on FOUR anti-gun bills at 1:30pm in Room 309 of the State Capitol in Santa Fe. These are among the most extreme gun control measures being considered in the entire nation.  If you have not made a trip to the Roundhouse to fight for your rights, now is the time!  

House Bill 27 by Rep. Joy Garratt (D-Albuquerque)

Expands Red Flag Law

Allows law enforcement to petition for red flag orders without credible information from reporting parties that someone poses a significant threat of causing imminent injury to himself or another, expands categories of individuals who can be reporting parties, requires immediate surrender of firearms to law enforcement upon service of a red flag order, and provides for search warrants to seize firearms from persons under red flag orders.

Raise the Age

Bans anyone under the age of 21 from purchasing or possessing any semi-automatic firearm, or any standard capacity magazine capable of holding more than 10 rounds of ammunition, with limited exceptions.  Also criminalizes the sale or transfer of ownership of these firearms or magazines to anyone under 21.

State Waiting Period

Imposes a 14-business day waiting period on firearms purchases by law-abiding citizens, which would make for the longest firearm purchase delay in the country.

Governor's Gun & Magazine Ban

Outlaws the manufacture, sale, transfer and possession of nearly all semiautomatic rifles and shotguns, as well as a number of handguns, that law-abiding citizens commonly own and use for self-defense, competition, and recreation. Current owners would be forced to register them with DPS by January 1, 2025, to maintain possession. Bans standard capacity magazines capable of holding more than 10 rounds. Attempts to supersede federal law by prohibiting certain NFA items outright.

Plan to attend Monday's hearing at 1:30pm in Room 309 of the State Capitol in Santa Fe and testify in-person or if you cannot attend, please try and participate virtually to OPPOSE House 27, House Bill 127, House Bill 129, and House Bill 137.

Also, House Bill 114 by Rep. Christine Chandler could be voted on by the full New Mexico House of Representatives early next week.  This measure would allow the state attorney general or a district attorney to bring an action for injunctive relief and civil penalties against anyone in the firearms industry for alleged violations of the newly devised Firearms Industry Accountability Act, vastly increasing their liability exposure when advertising legal products or conducting lawful business activities. Private causes of action are created without award limits.  This would bankrupt local firearms retailers and leave law-abiding citizens no way to exercise their Second Amendment right to purchase and own firearms. Please contact your State Representative and urge them to OPPOSE House Bill 114.
