Today, the House Insurance & Commerce Committee passed House Bill 1509 and advanced it to the House Floor, where it is eligible for a vote tomorrow. HB 1509, while seemingly well-intentioned, lacks essential provisions to adequately protect firearm financial privacy for consumers and businesses in Arkansas. House Bill 1509 lacks the necessary policies to protect lawful firearm owners and businesses. It fails to include critical provisions, such as prohibiting the use of firearm and ammunition-specific Merchant Category Codes by all financial institutions and lacks strong enforcement measures to safeguard Arkansans.
In contrast, House Bill 1443, backed by the NRA, has not been heard by the House Insurance and Commerce Committee. It will prohibit the use and financial discrimination of firearm and ammunition-specific Merchant Category Codes, which could be used to track firearm and ammunition purchases and create a registry of lawful gun and ammunition buyers. Additionally, HB 1443 provides a more vigorous enforcement mechanism that allows the Arkansas Attorney General to pursue legal remedies and enables the option for firearm retailers or customers to seek a court injunction for violations.
