On Monday, April 14th, the Senate passed House Bill 809, preventing localities from enacting "red flag" laws, by a vote of 29-19. It will now be transmitted to Governor Greg Gianforte's desk for his consideration.
NRA thanks lead sponsor Representative Mitchell, all legislators who supported this bill advanced through the legislature, and all NRA members and fellow Second Amendment advocates who engaged with their legislators in support of this bill.
HB 809 prevents local governments from enacting or enforcing an extreme risk protection order (ERPO) or accepting any grants that would aid in the adoption or enforcement of an ERPO. Red flag laws allow governments to seize firearms based on weak and nebulous standards of evidence and implement ex-parte hearings that would suspend an individual's Second Amendment rights without due process.
