On Wednesday, April 30th, the Montana Legislature adjourned sine die from the 2025 legislative session. Thanks to the hard work of NRA members and Second Amendment advocates, House Bill 809, which prevents localities from enacting "Red Flag" laws, passed both chambers and has been transmitted to Governor Greg Gianforte's desk.
The NRA thanks lead sponsor Representative Mitchell, all legislators who supported this bill, and all NRA members and fellow Second Amendment advocates who engaged with their legislators this session.
HB 809 prevents local governments from enacting or enforcing an extreme risk protection order (ERPO) or accepting any grants that would aid in the adoption or enforcement of an ERPO. Red flag laws allow governments to seize firearms based on weak and nebulous standards of evidence and implement ex-parte hearings that would suspend an individual's Second Amendment rights without due process.
