A petition for a writ of certiorari has been filed in the NRA-supported case, Kipke v. Moore, seeking Supreme Court review of Maryland’s sweeping carry restrictions enacted under the Gun Safety Act of 2023.
Following the NRA’s landmark Supreme Court victory in NYSRPA v. Bruen—which affirmed the right of all Americans to carry firearms in public—Maryland adopted a series of laws designating broad categories of public locations as “sensitive places” where carrying firearms is prohibited. The state also barred carry on private property open to the public unless the property owner expressly permits it.
The Maryland District Court enjoined most of the challenged restrictions. But on appeal, the U.S. Court of Appeals for the Fourth Circuit struck down only the private property default rule, while upholding all the “sensitive place” restrictions, including bans on carrying firearms in state parks and forests, government buildings, museums, public transportation, healthcare facilities, school grounds, stadiums, racetracks, amusement parks, casinos, locations that sell alcohol, and within 1,000 feet of a public demonstration.
The Petition argues that lower courts are eviscerating the right to bear arms and undermining Bruen by upholding expansive “sensitive place” regimes and urges the Supreme Court to reaffirm Bruen and clarify the proper framework for evaluating locational restrictions on the right to bear arms.
