House Bill 57, introduced by State Representative Allen Jaggi (R-18), would prohibit state and local authorities from confiscating firearms during a declared state of emergency, such as occurred in the wake of Hurricane Katrina. HB 57 (Emergency Powers) was preliminarily given the green light from the Wyoming House of Representatives. HB 57 is now waiting to be placed on the General File for a final vote by the House.
House Bill 137, introduced by State Representative Lorraine Quarberg (R-28), a bill that statutorily defined "no duty to retreat" (Castle Doctrine), was heavily amended in the House Judiciary Committee late Tuesday evening at the request of the Wyoming Prosecutors Association. As amended, the bill would continue to recognize "common law" which leaves decisions about whether to prosecute individuals who defend themselves in their homes in the hands of prosecutors and judges. The committee did not change the provision that residents who used deadly force against intruders would be immune from civil liability. While an important provision to Castle Doctrine was removed, it is very important that we continue to support civil immunity.
