Nevada Sheriffs Jump on Board with the NRA Despite NSCA Director's Missive

Thursday, August 18, 2011

As reported in previous alerts, last month the Nevada Sheriffs and Chiefs Association (NSCA) tabled a motion that would have authorized a letter to the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) asking to re-instate the instant background check exemption for Nevada concealed carry weapons (CCW) permit holders.

Currently, nine sheriffs throughout the state have communicated with the NRA and the Stillwater Firearms Association expressing their desire to move forward with a formal letter requesting the exemption.  This means a majority of sheriffs (nine out of 17) support the NRA's position.

An NRA member communicated with the NSCA through their website in the hopes that they would move forward as a body and not wait to conduct a "vote" before sending the formal request to BATFE.  In spite of the majority support, the Executive Director of the NSCA, Mr. Frank Adams, sent the following e-mail response, quoted exactly below:

Mr. XXXX, I find interesting for individuals like yourself to make a
statement as you did without knowing the all the circumstances of the
issue with BATFE.  Since this affects all the Sheriffs in the state and
they are the ones that must administer the CCW program, they must all
agree to move forward with this request.  BATFE santioned all of them
in 2004 because a couple did not comply with rules BATFE changed
without tell the Sneriffs, so as soon as all the Sheriffs are ready to
move forward with this request, they will do so.  Just because the
legislature changed the law does not mean that BATFE will reinstate the
exemption.  There is nothing in federal law that says they havel do it.
Alll they ever said was if Nevada changed its laws, they would
consider reinstating the exemption.  Knowing the current Washington
Administration, the reinstate of the exemption is on a done deal.  So,
please let the Sheriffs handle this in the proper manner.  It is
allways fullish to make statements and demands without knowing all the
facts.

Frank Adams
Executive Director
Nevada Sheriffs' and Chiefs' Association

During the 2011 legislative session, Assembly Bill 282 changed state law relating to the BATFE requirements necessary to receive the NICS exemption.  Mr. Adams testified in both Assembly and Senate committees that he had the full support of the NSCA in advocating for AB 282 and that once the requirements were met, a formal letter requesting the exemption would be sent.  It is apparent that now Mr. Adams believes that another vote must take place in order to just send the letter - and that it must be determined by a unanimous vote of the state's sheriffs!

Please contact the sheriffs below and politely ask that they communicate with their Executive Director and ask him to honor the commitment he made to state legislators advocating for AB 282 and send the letter without waiting for the next NSCA meeting on September 17.
