Nebraska: Legislature Passes Firearm Records Confidentiality Bill

On April 11th, the Nebraska Legislature voted 47-0 to pass Legislative Bill 902 to ensure that personal information contained in Firearm Permit and Purchase records will be protected from public records requests.  Shortly after passage, Governor Pete Ricketts stated:

“Nebraska is home to many outstanding gun owners, hunters, and sportsmen and women.  Thank you to Senator Bostelman and the Legislature for bringing this important bill.  As a lifetime NRA member, I know how precious Second Amendment rights are to Nebraskans.  This bill helps protect our rights.”

Legislative Bill 902, introduced and prioritized by Senator Bruce Bostelman (LD-23), will ensure the confidentiality of personal information associated with many firearm records.  Current law already guarantees that Concealed Handgun Permit holder personal information is confidential and protected from public records requests. Now many other records will be as well.

Even states with otherwise restrictive firearm laws like Hawaii, Massachusetts, New Jersey, and New York State protect licensee information from public disclosure, recognizing the public safety concerns of releasing this private information. In addition to releasing the confidential, personally identifying information of law-abiding permit holders who simply wish to protect themselves, this information, if publicly released, would likely include the names and addresses of current and former law enforcement, judges, undercover officers, private investigators, victims of domestic violence and individuals with no-contact order or orders of protection.
